The National Human Rights Commission (NHRC) has issued a strict warning to police forces across India, directing that any arrest or handcuffing done without proper investigation will result in a penalty of ₹2 lakh. The fine will be deducted directly from the salaries of the concerned police officers, including inspectors and constables.
Case Background
The matter arose from an incident in Betul, Madhya Pradesh (2016), where police officials arrested an accused without adequate investigation and unnecessarily handcuffed him. Following a complaint, the NHRC held this to be a serious violation of human rights and ordered compensation to the victim, to be paid from the officers’ own salaries.
NHRC Questions Police Conduct
The Commission expressed displeasure over the undue haste shown by the police, asking:
- Why was the arrest made in such a hurry without proper inquiry?
- Why were handcuffs used when they were not necessary?
The NHRC emphasized that arrest and handcuffing should only be carried out under exceptional circumstances, and not as a routine measure. Arbitrary action undermines the dignity and fundamental rights of individuals.
Warning to Police Nationwide
The Commission made it clear that in cases of violation, individual officers will be held personally accountable. Apart from monetary penalties, disciplinary action will also be initiated against those found guilty.
